1. Agreement

Key West Charter Boats ("the Site") is operated by David A. Little, Inc. ("we", "us"). By using the Site you agree to these terms. If you do not agree, do not use the Site. Your use of the Site is also governed by our Privacy Policy.

2. What the Site is

The Site is a business directory. It lists businesses and lets visitors find and contact them. We are not a party to anything that happens between you and a listed business. We do not perform the work, we do not inspect the businesses, and we do not guarantee their licences, insurance, pricing, quality or availability. Check them yourself before you hire or pay anyone.

3. Eligibility

You must be at least 18 years old and legally able to enter a contract. If you use the Site for a business, you confirm you are authorised to act for that business.

Advertising. Some placements on this Site are paid advertising. A paid placement is not an endorsement, a recommendation, or a statement that we have checked the advertiser.

8. Disclaimer of warranties

THE SITE AND EVERYTHING ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure or error-free, or that any listing, review, rating, description or contact detail is accurate, current or complete. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAVID A. LITTLE, INC., ITS OWNERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR CONNECTED WITH YOUR USE OF THE SITE — WHETHER THE CLAIM IS IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, AND EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED US DOLLARS ($100).

We are not liable for any dealing between you and a business listed on the Site, or for any goods or services you obtain from one. Some jurisdictions do not allow these limits, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence.

10. Indemnification

You agree to defend, indemnify and hold harmless David A. Little, Inc. and its owners, employees, agents and suppliers from any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising out of or connected with: (a) your use of the Site; (b) anything you submit to the Site; (c) your breach of these terms or of any law; or (d) your infringement of anyone else's rights. We may take over the defence of any such claim at your expense, and you will cooperate with us if we do.

11. Termination

We may suspend or end your access to the Site at any time, with or without notice. Sections on content licence, disclaimers, limitation of liability, indemnification and governing law survive termination.

12. Governing law and venue

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You and we agree that any dispute will be brought only in the state or federal courts located in the State of Florida, and both of us consent to the personal jurisdiction of those courts.

This choice of law does not remove any protection you have under the mandatory consumer law of the country you live in, and it does not affect the data-protection rights described in our Privacy Policy.

13. Changes to these terms

We may update these terms. The date at the top of this page shows the current version. Continuing to use the Site after a change means you accept the new terms.

14. General

If any part of these terms is held unenforceable, the rest stays in force. Our failure to enforce a term is not a waiver of it. These terms, with the Privacy Policy, are the whole agreement between you and us about the Site. You may not transfer your rights under these terms; we may transfer ours to a successor of our business.
